Acceptable Use Policy

This Acceptable Use Policy ("AUP") is part of the Terms of Service and applies to every user of the Ultimate Email Management System (the "Service") provided by Achieve IT.
This AUP exists to keep the Service safe, legal, and trustworthy for everyone using it. If you have any doubt about whether an intended use is allowed, ask first at [email protected].
1. Prohibited Content and Activities
You may not use the Service to generate, send, store, or transmit content that:
- Is illegal in your jurisdiction or the recipient's jurisdiction, including content that violates privacy, anti-spam, consumer-protection, financial, or export-control law.
- Is unsolicited commercial email sent in violation of Canada's Anti-Spam Legislation (CASL), the US CAN-SPAM Act, or equivalent laws. Every commercial message you send via the Service must comply with your local rules on consent, identification, and unsubscribe.
- Harasses, threatens, defames, or stalks any individual or group.
- Impersonates another person or organization in a way intended to deceive the recipient. (Sending on behalf of your own business as a reasonable communication is fine; impersonating a different entity is not.)
- Promotes hate, violence, or discrimination on the basis of protected characteristics.
- Is child sexual abuse material, non-consensual intimate imagery, or content that exploits or endangers children.
- Infringes intellectual-property or privacy rights of third parties (trademarks, copyrights, trade secrets, personal information).
- Facilitates fraud, phishing, scam operations, unauthorized money transmission, or identity theft.
- Distributes malware, ransomware, or other malicious software, or exploits or probes vulnerabilities in any system without authorization.
- Is pornographic or sexually explicit where the recipient has not opted in, or where illegal for the recipient to receive.
- Solicits donations or payments on behalf of misrepresented causes.
2. Operational Limits
You may not:
- Use the Service to send volume that exceeds your plan limits without upgrading.
- Create multiple accounts or tenants to evade plan limits, bans, or suspensions.
- Use automated means (scripts, scrapers) to interact with the Service except through documented APIs.
- Resell, sublicense, or white-label the Service without a written agreement from us.
- Use the Service in a way that interferes with, disrupts, or degrades the Service for other customers.
3. Security Expectations
You may not:
- Attempt to access accounts, data, or systems that are not yours.
- Probe, scan, or test the Service for vulnerabilities without our written authorization through a coordinated-disclosure process (contact [email protected]).
- Reverse-engineer, decompile, or attempt to derive the source code of the Service, except to the limited extent permitted by applicable law.
- Submit content specifically crafted to manipulate the AI in a way that causes harm to us, other customers, or third parties (including prompt-injection attacks, jailbreak payloads, or instructions intended to exfiltrate another user's data).

4. AI-Specific Restrictions
Because the Service uses AI, there are additional restrictions:
- You may not disable or work around the Service's safety guardrails, including the default restrictions on legal, financial, or refund decision categories.
- You may not configure auto-reply in a way that causes AI-generated messages to be presented to recipients as having been written personally by a human when they were not.
- You may not use the Service to generate content that could reasonably be mistaken for a real person's private communication for the purpose of deception or fraud.
- You may not use the Service to automate replies in high-stakes scenarios (e.g., emergencies, medical advice, legal proceedings) where a reasonable person would expect human judgment.
5. Data Handling Restrictions
You may not:
- Connect a mailbox you are not authorized to read and send from.
- Upload to the knowledge base material you do not have the right to use.
- Process personal data of individuals in jurisdictions where you have not established a legal basis (consent, contract necessity, legitimate interest) for that processing.
- Use the Service to process special categories of personal data (health, genetic, biometric, or similar) for purposes requiring heightened protections, without first discussing your use case with us.
6. Reporting Violations
If you become aware of content or activity on the Service that violates this AUP (whether yours or someone else's), notify us at [email protected] promptly.

For copyright or IP infringement: [email protected] with the details of the alleged infringement and your ownership.
7. Enforcement
Violations may result in:
- A warning and request to cure within a reasonable period.
- Temporary suspension of the affected functionality or the whole account.
- Termination of the account per the Master Service Agreement.
- Referral to law enforcement for illegal activity.
- Civil action where damage has been caused.
We will apply the minimum response reasonably necessary to address the violation. For severe violations (active harm, illegal content, imminent security risk), we may suspend immediately without prior notice.
8. Changes to this AUP
We may update this AUP to address new risks, new features, or changes in law. Material changes will be communicated at least 30 days in advance to the primary contact on your account and posted at achieveit.ca/aup.
This AUP is part of the Terms of Service. By using the Service, you agree to it.
